"Pre-arrangements can be changed from time to time and at any time, and such changes include
the purchasers selection of a different funeral firm, and / or depository."

 

Meaning of Irrevocability. The acceptance of this agreement creates an Irrevocable Trust which means that any withdrawal or other disposition of the deposits on account plus accrued interest, for any purpose, will be and must legally be refused by the Funeral Director, the Trustees, the Trust Fund and any officer, employee, or agent. Completion of this Irrevocable Trust Agreement shall constitute an itemized contract for future delivery of the merchandise specified or its comparable substitute, subject to the other previsions of this Agreement.

Irrevocability, Severability and Portability. This agreement is not revocable during the lifetime of the Beneficiary. However, the Funeral Arrangements are fully severable from this Agreement, and can be changed from time to time, and at any time, and such changes include the Purchasers selection of a different Funeral Firm.

Right to Statements on Request. Within thirty (30) days of a request by the Purchaser or his legal representative, the Purchaser will be provided with a statement identifying the location of the account in which the deposit is maintained, the amount of such account and interest it has earned.

Payments to the Funeral Firm. Any deposit, or deposits along with accrued income, will be payable to the Funeral Firm upon presentation of (a) a written authorization form executed by the Funeral Firm, (b) a certified death certificate of the beneficiary, and (c) provided the Funeral Firm has substantially furnished the funeral services and merchandise specified in the Pre Need statement.

Refunds. Prior to providing any merchandise or rendering of any services as intended by the Pre Need Statement, any deposits or deposits along with interest earned are fully refundable to the Purchaser of his legal representative upon the presentation of a notarized written demand of the Purchaser or his legal representative to the Trustees. Except for payments to the Funeral Firm after services have been rendered or merchandise provided, any such payments or refunds will be made payable only in the name of the Purchaser or his legal representative and not to any other party.

Revoking the Funeral Arrangements or this Agreement. Both the funeral arrangements specified in the Pre Need statement and this Agreement, together or separately are revocable by the Purchaser at any time prior to the rendering of funeral services by the Funeral Firm or the providing of any merchandise, with the total amount of any deposit or deposits and interest income being fully refundable as specified in the paragraph above.
